Se ordenó remitir el expediente de tutela al Juzgado Segundo Penal Municipal de Tunja para que adelante la correspondiente actuación judicial, toda vez que estando vigente el Decreto 1382 de 2000, conforme a la situación jurídica existente en la actualidad, la Corte Constitucional encontró que, presentándose un conflicto aparente de competencia, en el presente caso el conocimiento de la tutela corresponde al citado juzgado en virtud de lo establecido en el Art. 1º, numeral 1º, inciso 3º, del mencionado Decreto.
